Step 1. Mail Letter #3 of the Administrative Procedure Act To The Mortgage Company

 

Mail to the bank certified mail with signature requested the Ltr#3 – Notice of Default LTR to NewRez-LTR3 COLIN SAMUEL (Check Downloads Folder). Give the bank 21 days to respond.  While waiting for them to respond, which they will not, go ahead and file a revocation of power of attorney, reconvey the deed, assign a new trustee.  Make sure you send a copy to all parties involved via certified mail with signature requested.  Record the documents with the recorder of deeds.

You will find the forms 8281, 1099-A, 1099-C on the IRS.gov website.

 

 

Step 3: Revoke The Mortgage Company’s Power Of Attorney, Substitute Trustee, Reconvey The Deed, etc…

 

At least fourteen days after you’ve sent out Letter #2, whether the mortgage company responded or not, which most likely they will not respond, file a revocation of Power of Attorney & Trustee, substitution of trustee, Reconveyance of the deed (check Download folder for templates/samples). The exhibit A mentioned in the sample revocation of power of attorney would be a copy of letter #2, and a copy of the promissory note which should be attached to the revocation of power of attorney as Exhibit A. Also file the substitution of trustee, etc., with the recorder of deeds. Make sure the bank and all involved receive copies of the filed revocation of POA, and substitution of trustee, reconveyance of deed.

    Step 4: How To Add Your Tender Of Payment (Bill of Exchange) Into                   The Public Record Via a UCC3

     

     

    Besides adding your tender of payment into the public record via a UCC3, also add your Homestead/Land patent info to a UCC3. Every asset, tender of payment, important documents, etc pertaining to your legal fiction must be added to your UCC1 via the UCC3 Amendment.  Make sure you are filing the correct UCC3 form from your state UCC website as some state’s forms are slightly different.

     

    Step #5: Transfer Your Property To Your Living Trust

    It is highly recommended that you do a warranty deed with fee simple transfer to your living trust. Make sure you stamp your document and record with the recorder of deeds. Following are the documents in the Downloads folder that you would need to accomplish Task #7:
