How To Get A Satisfaction Of Mortgage With Or Without The Mortgage Company (Part I)
Step 1
Send an email notification to info@backtonaturalliving.com letting us know that you would like to have your Court Case Order For Mortgage Satisfaction prepared.
Step 2
While your court case Order is being prepared (2-3 days), create and file a form 56 and a form 56-F making the manager and the deputy of the recorder of deeds your temporary fiduciaries. Also create and file a form 56 and form 56-F for the County Tax Assessor.
Step 3
Please take the time to read the 60-page Uniform Residential Mortgage Satisfaction Act. This way, if your court case order is denied, you will be a step ahead of the “game,” and have a “Satisfaction Agent,” notify your mortgage company that you are going to file a satisfaction of mortgage and also file it with your county recorder of deeds for you. NOTE: Once you’ve received your Court Case Order back from us, make sure you take your time and add all exhibits and then file it with the District Court and make sure you stamp the case Order, etc. Once you’ve filed your case Satisfaction Of Mortgage Order with all exhibits, you must give the mortgage company 30 days to respond to the Order and also for the Judge or County Clerk to approve the Order. If the Order is denied then you must hire a satisfaction agent to do the job for you as explained in the video below.

Step 1 – Endorse Your Promissory Note
This is optional, but recommended that you have your satisfaction agent send to your mortgage company’s CFO or CEO, an amended promissory note that is signed with you being the Settlor, power of attorney, authorized representative and beneficiary, which is the way it should have been done at closing. Also make sure to endorse it “paid to the order ” to your original mortgage company as you saw in the example in the video above. It’s best to order a self-inking stamp. I bought mine years ago from Vistaprint.com.
Again I highly recommend sending an amended promissory note even though you’ve tendered “payment” via a bill of exchange and you also have a CUSIP number for the original promissory note. Yes, this is extra and it puts them even further into a corner which they won’t be able to get out of without doing what’s right.
Step 2 – How To Hire A “Satisfaction Agent” To Record Your Mortgage Satisfaction
The Mortgage Satisfaction Procedure link below contains the 5 following documents that must be included in the process of using a “Satisfaction Agent” to file into the public record, a Satisfaction of Mortgage for you:
1. PRESENTMENT OF NOTICE OF PENDING AFFIDAVIT OF SATISFACTION – UNDER NOTARY SEAL (with certificate of service).
After preparing your (5) five “Mortgage Satisfaction Procedure” documents, you would have to hire a notary (Satisfaction Agent) from a UPS Store near you to mail your documents to your mortgage company’s CFO. Yes, there are notaries in The UPS Store that you can hire to sign your documents, mail them out, and record your Mortgage Satisfaction for you. Have your Satisfaction Agent mail out Documents #1 and #2 to your mortgage company CFO, giving him 30 days to respond. After 30 days, if he fails to respond, have your Satisfaction Agent send out Documents #4 and #5 to the CFO. After another 30 days without response, have your Satisfaction Agent file Document #3 (AFFIDAVIT OF SATISFACTION) along with copies of the other four documents into your county recorder of deeds record.

Once your Satisfaction Agent records your mortgage satisfaction with the county recorder of deeds, make sure the following from Module #2 that some folks might not have been able to accomplish (due to circumstances beyond their control) are finally completed such as:
- Record with the recorder of deeds your Homestead Declaration Template with meridian, allodial title land patent (stamp the hell out of it)
- Get your property/land tax code changed to “Private” and also changed to Tax Exempt on the County Tax Assessor’s public records and State records
- Make sure to follow up with your State Secretary to get a passport. It is extremely important that you no longer have in the records a US Citizen Passport. Also make sure you upgrade your driver’s license.
